Muhammad Dzakir Gusti

known to many as Gusti

is an associate at Assegaf Hamzah & Partners (AHP), with a primary focus on dispute resolution and commercial litigation. Gusti is a qualified advocate registered with the Indonesian Bar Association (PERADI) and bankruptcy receiver and PKPU administrator with the Indonesian Receivers and Administrator Association (AKPI). Gusti earned his Bachelor of Laws (S.H.) degree from the University of Airlangga, majoring in procedural law and supplemental coursework in business law.

Since joining the firm, Gusti has advised a wide range of clients, including major state-owned enterprises and multinational corporations, on complex litigation and arbitration matters across various sectors. He is also actively involved in transactional and corporate advisory work, particularly in areas relating to employment, real estate, competition law, procurement, and foreign investment. He has also contributed to national legislative initiatives, particularly in areas relating to advocate reform and land procurement.

Prior to joining AHP, Gusti gained valuable experience at the East Java Provincial Prosecution Office and a public notary office in Surabaya, which provided him with early exposure to both public and private legal practice. 

Beyond his legal practice, Gusti is deeply committed to social impact. He actively supports community-based initiatives and legal education programs. He continues to mentor future legal professionals through leadership training and legal competitions at his alma mater.

Criminal Litigation

  • Advised a US multinational corporation on allegations of criminal misconduct by its employee before the Kraksaan District Court;
  • Advised and accompanied a US multinational corporation for allegations of criminal acts of consumer protection and trade during pre-investigation and investigation stage at East Java and Banten Regional Police Office;
  • Advised and accompanied the Director and General Manager of a U.S. multinational corporation during a public procurement investigation involving a government hospital, conducted by the East Java Police Office;
  • Advised and accompanied clients in wholesale trade-related criminal proceedings before various authorities, including Tuban, Sambas, and Situbondo Police Precincts, Lampung Regional Police, Jambi Regional Prosecutor’s Office, Madiun Prosecutor’s Office, and the Attorney General’s Office;
  • Advised and accompanied a State-Owned Enterprise company in a counterfeit goods investigation by the Task Force of the Ministry of State-Owned Enterprises;
  • Advised and accompanied Malaysian and French nationals in an immigration investigation conducted by the Surabaya Immigration Office;
  • Advised and assisted client during the investigation stage and hearing stage in relation to the allegation of the violation of competition law before the Indonesian Competition Commission;
  • Advised client in the investigation of the maladministration practice by the Ombudsman of the Republic of Indonesia;
  • Advised a U.S. multinational corporation on environmental regulatory compliance in a matter involving the Depok Environmental Agency and Ministry of Environment

Commercial Litigation

  • Advised a chain-branded hotel in Bali on real estate dispute before Singapore International Arbitration Centre tribunal;
  • Represented PT Ecolab International Indonesia in employment disciplinary proceedings and industrial relations disputes involving bipartite negotiations and tripartite mediation with the Local Manpower Office;
  • Represented PT Ecolab International Indonesia in a civil lawsuit before the Surabaya District Court;
  • Represented PT Cikal Edukasi Surabaya in a commercial dispute in Surabaya Commercial Court;
  • Represented client during negotiation with counterpart to enter into a settlement agreement and register the agreement before relevant District Court;
  • Represented PT Air Products Indonesia in a debt recovery lawsuit valued at IDR 21 billion against a distributor before the Jombang District Court;
  • Represented PT Tripatra Engineers Constructors in public information disclosure dispute before Central Information Commission;
  • Advised a Japanese wood manufacturing company in a commercial dispute arising from a fire incident, with a claim value of approximately IDR 25 billion;
  • Represented PT Salonok Ladang Mas in a tort dispute valued at IDR 58 billion at the cassation stage before the Supreme Court of Indonesia, resulting in a favorable ruling;

General Corporate

  • Advised client on privacy policy and terms of use for the e-commerce industry in Indonesia;
  • Advised leading mining company in Indonesia in relation to import and export regulations as well as corporate compliance regulations;
  • Advised leading mining company in Indonesia in its review to 20+ internal standard operational procedure;
  • Advised leading international social media providers regarding foreign investment in Indonesia;
  • Advised and reviewed ± 250 agreements related to various issues faced by clients, including but not limited to i) employment; ii) domestic and foreign trade; iii) customs and duties; iv) procurement; v) competition; vi) shares and real estate acquisition;
  • Advised client in the acquisition and restructuring of a group of companies engaged in port services;
  • Advised Indonesian manufacturing company in the divestment corporate action;
  • Advised Japanese company in the energy sector in relation to data privacy, employment, anti-bribery, insider trading, and whistleblowing provision in Indonesia;
  • Advised Swiss industrial company on the divestment of shares valued at IDR 10 billion and in connection with multiple loan facilities extended by the client, including: (i) USD 1,600,000; (ii) USD 2,800,000; (iii) USD 320,000; and (iv) USD 3,903,786.40;
  • Conducted legal due diligence on German multinational company in relation to (i) employment audit; (ii) assets audit.
  • Conducted legal due diligence on a data centre company in relation to (i) business licenses audit; (ii) assets audit; and (iii) employment audit;

General Corporate

  • Advised the Ministry of the State Secretariate in relation to implementing regulation of Omnibus Law on land procurement for public interest;
  • Advised and reviewed the Bill of Chemical Material drafted by the Indonesia’s House of Representatives of Republic of Indonesia;
  • Advised Law Reform Acceleration Task Force (established by Coordinating Ministry for Political, Legal and Security Affairs) on the Presidential Regulation concerning Advocate Reform;
  • Assisted in the drafting and review of the Presidential Regulation and Minister of Agriculture Regulation on the Subsidized Fertilizer Policy.
